American Distributors/Importers Alliance Hails Commerce Department Decision to Lower Preliminary Antidumping Rates across
DOC decision means all three Mandatory Respondents were found to have zero percent dumping
WASHINGTON--(BUSINESS WIRE)-- "We are very pleased the Commerce Department (DOC) has now recognized that there was zero dumping by all three Mandatories in the Multilayered Wood Flooring from China antidumping (AD) and countervailing duty (CVD) cases now pending,” said Jonathan Train, president of the Alliance for Free Choice and Jobs in Flooring (www.choiceandjobs.com).
Train said, “Commerce had total discretion to amend the various other AD rates after the correction of clerical errors that reduced the rate for Respondent Samling Company down from 10.88% to zero -- and they used that discretion to produce a result where almost all flooring imports will be subject to either 0% or less than 10% additional duties -- total for CVD and AD together -- until the final determinations in the fall.”
Train explained that the DOC decision means that all three Mandatory Respondents were found to have zero dumping. Two of the three were assigned zero dumping rates in the original preliminary decision announced in May.
Train noted that “After extensive investigation, the DOC has yet to find any evidence of significant dumping or subsidies, despite the Petitioners’ claims of dumping as high as 280%. We believe the Petitioners’ initial allegations were wildly inaccurate and erroneous. We believe their problems in the flooring supply chain were caused by their own business decisions and not by any unfair competition.”
Train confirmed that "Samling requested that the DOC review their preliminary antidumping rate, alleging three ministerial errors. The DOC confirmed that inadvertent errors had occurred. The DOC’s corrected calculations have resulted in assigning a zero for Samling, 6.78% for over 70 companies on the ’Separate Rates List’ and 27.12% for the small number of imports affected by the ’Country Wide Rate’. These rates are in effect until October.”
The Alliance for Free Choice and Jobs in Flooring (AFCJF) was formed in January 2011 to oppose the Petitioners. AFCJF members are all American independent flooring importers, distributors and retailers, or in allied industry sectors.
